By accessing and using Pourfolio, you agree to be bound by these Terms of Service. If you do not agree to any part of these terms, you may not use our service. We reserve the right to update these terms at any time, and your continued use of Pourfolio constitutes acceptance of the updated terms.

2. Account Responsibilities

When you create an account, you are responsible for:

• Providing accurate and complete information during registration
• Maintaining the confidentiality of your password and account credentials
• Notifying us immediately of any unauthorized access to your account
• All activity that occurs under your account, whether authorized by you or not

You agree not to share your account credentials with others or use someone else's account without permission.

3. Service Availability

Pourfolio is provided on an "as-is" and "as-available" basis. While we strive to maintain high availability, we do not guarantee that the service will be uninterrupted, error-free, or completely secure. We may perform maintenance, updates, or make changes to the service at any time.

We are not responsible for any downtime, data loss, or service interruptions that may occur.

4. Beta Access and Pricing

Pourfolio is currently offering free access to the Pro tier for all users until December 31, 2025. After this date, users will be required to select a subscription plan (Freemium, Maker, or Pro) to continue using the service.

Current pricing and plan details are available on our pricing page. Prices may change with notice, but any changes will not affect your current billing period.

5. Your Content and Data

Ownership: You own all content you create and store in Pourfolio, including projects, molds, materials, images, and notes. By using our service, you grant us a limited license to store, process, and display your content to provide the service.

Data Rights: You retain all rights to export, backup, or delete your data at any time. You are responsible for maintaining backups of important information outside of Pourfolio.

License to Pourfolio: By uploading images or content to Pourfolio, you grant us permission to store and display that content as necessary to operate the service.

6. Prohibited Uses

You agree not to use Pourfolio for:

• Illegal activities or content that violates any applicable law
• Harassment, abuse, or threatening behavior toward other users or staff
• Uploading malware, viruses, or harmful code
• Attempting to access the system unauthorized or bypassing security measures
• Reverse engineering, decoding, or attempting to discover the source code
• Scraping, crawling, or automating access to the service
• Spamming or sending unsolicited messages
• Using the service to compete with or harm Pourfolio

7. Termination

We may suspend or terminate your account at any time, for any reason, without notice. Reasons for termination may include violation of these terms, illegal activity, payment failure, or at our sole discretion.

Upon termination, your access to the service will be revoked, but you may request a data export before your account is deleted (subject to your subscription plan's export limits).

8. Limitation of Liability

Disclaimer: Pourfolio is provided "as-is" without warranties of any kind, expressed or implied. We do not warrant that the service will be error-free, uninterrupted, or fit for your specific purpose.

Limitation: To the maximum extent permitted by law, Pourfolio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or business, even if we have been advised of the possibility of such damages.

In no event shall our total liability exceed the amount you have paid to us in the 12 months preceding the claim.

9. Indemnification

You agree to defend and indemnify Pourfolio and its founders, employees, and partners from any claims, damages, or legal fees arising from your use of the service, violation of these terms, or violation of any applicable law.

10. Changes to These Terms

We may update these Terms of Service at any time. When we make material changes, we will notify you by email or by posting a prominent notice on the website. Your continued use of Pourfolio after any changes means you accept the new terms.

11. Governing Law

These Terms of Service are governed by and construed in accordance with applicable law, and you agree to the exclusive jurisdiction of the courts in that jurisdiction.
